spouse or intimate partner, by a person similarly situated to a spouse of
the victim under the domestic or family violence laws of the jurisdiction
receiving grant monies, or by any person against an adult or youth
victim who is protected from that person’s acts under the domestic or
family violence laws of the jurisdiction.
Stalking: Engaging in a course of conduct directed toward another
person that wouldcausea reasonableperson to:
o
fear for hisor her safetyor thesafetyof immediate family
membersor closeacquaintances; or
o
suffer substantial emotional distress.
Non-Consensual Sexual Contact:
o
deliberate indecent and/or unwelcomedbrushing, touching,
grabbing, pinching, patting, huggingand/or kissingof aperson’s
intimateparts (includinggenitalia, groin, breast or buttocks), or
clothing coveringanyof thoseareaswithout EffectiveConsent; or
o
usingphysical force, violence, threat, intimidationor coercion to
causea person to touchhisor her ownor another person’s intimate
parts.
Non-Consensual Sexual Intercourse
: Penetration (anal, oral, or vaginal) by a
penis, tongue, finger or inanimateobject that occurswithout EffectiveConsent.
Sexual Exploitation
: Taking sexual advantage of another person without
EffectiveConsent which includes, but isnot limited to:
o
Causingor attempting tocause Incapacitation inorder togain
sexual advantageover suchother person;
o
Causing theprostitutionof another person;
o
Recording, photographing, or transmitting identifiable
imagesof privatesexual activityand/or the intimate
parts (genitalia, groin, breasts, or buttocks) of another
person;
o
Goingbeyond theboundariesof consent suchas
allowingothers to secretlywatch youengage in
consensual sexor sexual activity;
o
Reproductionof a recorded consensual sexual act
without EffectiveConsent for distribution (e.g. online
postingof videos, photographs, or audiosdepictinga
consensual sexual act);
o
Engaging in voyeurism;
o
Engaging in exhibitionismand intentionallyexposingoneself in
an unwelcomedmanner;
o
Knowinglyor recklesslyexposinganother person toa
significant riskof aSTI (SexuallyTransmitted Infection) or HIV.
Rights of Individuals involved in Domestic/Intimate Partner Violence,
StalkingandSexualMisconduct Situations
Upon written request and in accordancewith the Family Educational Rights and
PrivacyAct of 1974 (FERPA), the institutionwill disclose to thealleged victim of a
crime of violence or non-forcible sex offense the report on the results of any
disciplinary proceeding conducted by the institution against a student who is the
alleged perpetrator of such crimeor offense.
