programs or activities and creates a working, learning, program or activity
environment that a reasonablepersonwould find intimidating, hostileor offensive.
The exclusive purpose of this Policy is to protect Students from sex
discrimination, consistent withboth federal regulatory lawand the requirementsof
the First Amendment to theUnited States Constitution. Sexual Harassmentmay,
when unwelcome, include:
o
sexual advances;
o
requests for sexual favors;
o
actsof sexual violence;
o
leering--i.e., staring ina sexuallysuggestivemanner;
o
makingoffensive remarksabout looks, clothingor bodyparts;
o
tellingsexual or lewd jokes,makingsexual gesturesor
displayingpornography;
o
sending, forwardingor solicitingsexuallysuggestive letters,
notes, emailsor images;
o
gender-basedactivity, not of a sexual nature, e.g., gender
harassment andgender identity harassment.
Sexual Assault:
Rape: Penetration, nomatter how slight, of the vagina or anuswith any
body part or object, or oral penetration by a sex organ of another
person, without the consent of the victim. The carnal knowledge of a
person, without the consent of the victim, including instanceswhere the
victim is incapable of giving consent because of his/her age or because
of his/her temporary or permanentmental or physical incapacity.
Sodomy: Oral or anal sexual intercourse with another person, without
the consent of the victim, including instances where the victim is
incapable of giving consent because of his/her age or because of
his/her temporaryor permanentmental or physical incapacity.
Sexual Assault with an Object: To use an object or instrument to
unlawfully penetrate, however slightly, the genital or anal opening of the
body of another person, without the consent of the victim, including
instances where the victim is incapable of giving consent because of
his/her age or because of his/her temporary or permanent mental or
physical incapacity.
ForcedFondling:
The touching of private parts for the purpose of sexual gratification
without the consent of the victim, including instances where the victim
is incapable of giving consents because of age or his/her temporary or
permanentmental or physical capacity.
Statutory Rape: Non-forcible sexual intercourse with a person who is
under the statutoryageof consent.
Sexual Violence:
Dating Violence: Violence committedby a personwho is or has been in
a social relationshipof a romanticor intimatenaturewith thevictim; and
where theexistenceof such a relationshipshall bedeterminedbasedon
a considerationof the following factors:
o
the lengthof the relationship;
o
the typeof relationship;
o
the frequencyof interactionbetween thepersons involved
in the relationship.
Domestic Violence: Felony or misdemeanor crimes of violence
committed by a current or former spouse or intimate partner of the
victim, bya personwithwhom the victim shares a child in common, bya
person who is cohabitating with or has cohabitated with the victim as a
